Richard N., « pas assez gay » pour être protégé par la Belgique ?

Empêchons la déportation de Richard ce 14 octobre.

Depuis six mois, Richard N., demandeur d’asile gay, habitant à Liège depuis plusieurs années, est injustement détenu dans le centre fermé de Steenokkerzeel 127bis. Le 14 octobre prochain, L’État belge, remettant en question l’orientation
sexuelle de Richard, souhaiterait exécuter son ordre de quitter le territoire, lui enlevant ainsi le droit à une protection internationale.
Or, déporter Richard dans son pays d’origine, le Cameroun, où l’homosexualité est répréhensible pénalement (la peine de prison allant de 6 mois à 5 ans), pourrait mettre sa vie en péril. En effet, outre les atteintes aux droits fondamentaux des personnes détenues, Amnesty International et Human Rights Watch rapportent de nombreux faits de violence envers les personnes LGBTQIA+ : traitements discriminatoires, maltraitance physiques et psychologiques, actes de tortures, viols et meurtres.

Rappelons que le 20 septembre dernier, le député fédéral Écolo Simon Moutquin a interpellé la Secrétaire d’Etat à l’Asile et la Migration, Nicole de Moor (CD|V), sur l’expulsion de Richard N. Il a demandé à la Secrétaire d’Etat son opinion sur la situation des personnes LGBTQIA+ au Cameroun et Nicole de Moor a
avoué qu’elle était très problématique. Pourtant Richard reste, à ce jour, détenu et risque d’être expulsé ce
14 octobre.
Notons que le refus du CGRA (Commissariat Général aux Réfugiés et Apatrides) d’offrir à Richard la protection internationale dont il a besoin est contraire à la Convention de Genève et à la charte des droits fondamentaux de l’Union européenne dont est signataire la Belgique. Qui plus est, ce refus est absolument incompréhensible puisque Richard est ouvertement gay et est, d’ailleurs, membre actif de l’association arc- en-ciel de Liège depuis 2018. En outre, son compagnon et lui désiraient rendre leur union officielle quelque temps avant son arrestation.
Bien que les condamnations de la Belgique par la CEDH (Cour Européenne des Droits de l’Humain) soient devenues aussi fréquentes que sans conséquences, le Comité de Soutien à Richard refuse, non seulement, de s’y habituer ; mais aussi que cette pratique puisse s’installer en toute impunité et dans le silence.
Depuis plusieurs mois, le Comité, composé de nombreux citoyen.ne.s et collectifs se mobilise pour visibiliser la situation de Richard avec une pétition signée par près de 500 citoyens. C’est donc au nom de l’égalité et de la justice pour tou.te.s que le Comité de Soutien à Richard exige la protection internationale et la libération immédiate de Richard N.

Richard N., « niet homo genoeg » om beschermd te worden door België ?

Help de deportatie van Richard op 14 oktober voorkomen.

Richard N., een homoseksuele asielzoeker die al enkele jaren in Luik woont, wordt al zes maanden onterecht vastgehouden in het gesloten centrum Steenokkerzeel 127bis. Op 14 oktober wil de Belgische regering, die de seksuele oriëntatie van Richard in twijfel trekt, zijn bevel om het land te verlaten uitvoeren en hem zo zijn recht op internationale bescherming ontnemen.

De uitzetting van Richard naar zijn land van herkomst, Kameroen, waar homoseksualiteit strafbaar is (de gevangenisstraf varieert van 6 maanden tot 5 jaar), zou zijn leven in gevaar kunnen brengen. Amnesty International en Human Rights Watch hebben melding gemaakt van talloze gevallen van geweld tegen LGBTQIA+ mensen, waaronder discriminerende behandeling, fysieke en psychologische mishandeling, marteling, verkrachting en moord.
Op 20 september heeft Écolo parlementslid Simon Moutquin staatssecretaris voor Asiel en Migratie Nicole De Moor (CD&V) aan de tand gevoeld over de uitzetting van Richard N. Hij vroeg de staatssecretaris naar haar mening over de situatie van LGBTQIA+ mensen in Kameroen, en Nicole de Moor gaf toe dat deze zeer problematisch is. Richard blijft echter in hechtenis en riskeert gedeporteerd te worden op 14 oktober.

De weigering van het CGVS (Commissariaat-generaal voor de Vluchtelingen en de Staatlozen) om Richard de internationale bescherming te bieden die hij nodig heeft, is in strijd is met de Conventie van Genève en het Handvest van de grondrechten van de Europese Unie, die door België werden ondertekend.
Bovendien is deze weigering totaal onbegrijpelijk aangezien Richard openlijk homo is en sinds 2018 actief lid is van de Luikse arc-en-ciel vereniging. Meer nog, hij en zijn partner wilden hun verbintenis officialiseren nog voordat hij werd aangehouden.

Hoewel de veroordelingen van België door het EHRM (Europees Hof voor de Rechten van de Mens) even frequent als onbeduidend zijn geworden, weigert het steuncomité van Richard zich daarbij niet alleen neer te leggen, maar willen ze ook niet toestaan dat deze praktijken straffeloos en in stilte worden voortgezet.
Al maandenlang zet een steuncomité, bestaande uit talrijke burgers en verenigingen, zich in om de situatie van Richard onder de aandacht te brengen, met een petitie die door bijna 500 burgers werd ondertekend.
In naam van gelijkheid, rechtvaardigheid en menselijke waardigheid voor iedereen eist het steuncomité van Richard internationale bescherming en de onmiddellijke vrijlating van Richard N.

Richard N., “not gay enough” to be protected by Belgium ?

Let’s stop Richard’s deportation this October 14.

For the past six months, Richard N., a gay asylum seeker living in Liège for several years, has been unfairly detained in the Steenokkerzeel 127bis center. The Belgian state, questioning his sexual orientation, is attempting to execute its expulsion order on October 14, thus denying Richard’s right to international protection. Deporting Richard to his country of origin, Cameroon, where homosexuality is criminally punishable (prison sentences ranging from 6 months to 5 years), could put his life in danger. In addition to violations of the fundamental rights of
detained people, Amnesty International and Human Rights Watch report numerous acts of violence against LGBTQIA+ people in the country ; discriminatory treatment, physical and psychological abuse, torture, rape and murder.

On September 20 of this year, Écolo federal deputy Simon Moutquin questioned the Secretary of State for Asylum and Migration, Nicole de Moor (CD|V), on the expulsion of Richard N, and on the situation of LGBTQIA+ people in Cameroon. The Secretary herself admitted that the latter is problematic. Despite this,
Richard remains, to this day, detained and risks being deported on October 14.
The refusal of the CGRS (General Commission for Refugees and Stateless Persons) to offer Richard the international protection he needs is at odds with the Geneva Convention and the Charter of Fundamental Rights of the European Union that Belgium has committed to uphold. This refusal is absolutely incomprehensible since Richard is openly gay and is, moreover, an active member of the rainbow association of Liège since 2018. Richard and his partner had even begun legal proceedings to make their union official when his arrest took place. Condemnations of Belgium by the ECHR (European Court of Human Rights) are frequent yet have yet to have entailed consequences. The Richard Support Committee not only refuses to get used to this, but also to the fact that this practice can take place with complete impunity and in silence. For several months, the Committee, made up of numerous individuals and local organizations, has been acting to raise awareness of Richard’s situation with a petition signed by nearly 500 citizens. It is therefore in the name of equality and justice for all that the Richard Support Committee demands international protection and the immediate release of Richard N.
